Contractual Relationship

These Terms of Use (“Terms”) govern your access to and use of the Services (“Services”) offered by Freeber LLC, a company incorporated and operating in Wyoming. Company address: 30 N. Gould St., Ste R, Sheridan, WY 82801. PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING ANY OF OUR SERVICES. By accessing and using the Services, you agree to these Terms, establishing a contractual relationship between you and Freeber LLC. If you do not agree to these Terms, you are not permitted to access or use the Services. These Terms replace any previous agreements or understandings with you. Freeber LLC reserves the right to terminate these Terms or any Services provided to you at any time, for any reason, and may deny you access to any or all parts of the Services. Some Services may be subject to additional terms, such as those for specific events, activities, or promotions, which will be communicated to you. These Additional Terms are part of these Terms and take precedence in the event of a conflict. Freeber LLC may modify these Terms of Service periodically. Such changes will be effective when posted on this page or when updated policies or supplementary terms are posted for the relevant Services. Continued use of the Services after such changes constitutes acceptance of the modified Terms. The Services

Freeber provides services including passenger transportation, package delivery, and food delivery. Note that Freeber does not perform these transport activities directly; instead, these services are provided by third-party drivers through our platform. Freeber’s role is to connect users with service providers, and therefore, the responsibility and quality of the services lie with the drivers. Users assume responsibility for any risks associated with using the services. While Freeber strives to ensure safety for both passengers and drivers, we are not responsible for issues arising during transport. Freeber employs security measures such as mutual rating systems for drivers and passengers. In case of an accident, Freeber will provide necessary data to insurance companies for damage settlement and cooperate with authorities in investigations.

Limitations

You agree not to: (i) remove any copyright, trademark, or other proprietary notices from the Services; (ii) reproduce, modify, create derivative works based on, distribute, license, rent, sell, or publicly display the Services without Freeber’s explicit permission; (iii) decompile, reverse engineer, or disassemble the Services except as allowed by law; (iv) link to, mirror, or frame any part of the Service; (v) use programs or scripts to scan, index, survey, or data mine the Service, or excessively burden its operation; or (vi) attempt unauthorized access to any aspect of the Service or damage related systems or networks.

Use of the Services

User Accounts:

To access most Services, you must create and maintain an active personal user account (“Account”). You must be at least 18 years old or of legal age in your jurisdiction to obtain an Account. When creating an Account, you must provide accurate personal information, including your name, address, mobile number, and a valid payment method (credit card or approved payment partner). You agree to keep your Account information up-to-date. Failure to do so, including using an invalid payment method, may result in loss of access to Services or termination of your Account. You are responsible for all activities under your Account and must keep your credentials secure. You may only have one Account unless otherwise permitted by Freeber.

User Requirements and Conduct:

The Service is not available to individuals under 18 years old. You may not permit others to use your Account or allow anyone under 18 to use the Delivery Services unless accompanied by you. You may not transfer your Account to another person or entity. You agree to follow all applicable laws and use the Services for lawful purposes only, without causing inconvenience, confusion, or harm to others. You may be asked to verify your identity to access or use the Services, and refusal may result in denial of access.

Text Messages:

By creating an Account, you consent to receive informational text messages (SMS) as part of the Services. You can opt-out at any time by emailing Freeber with your request and mobile number. Opting out may impact your use of the Services.

Promo Codes:

Freeber LLC offers promotional codes for special discounts and offers. These codes might include free rides, discounted fares, or other exclusive offers. Freeber LLC reserves the right to suspend or delete accounts if promo codes are misused, such as through irregular use or by circumventing the promotion’s purpose. Promo codes must be used as intended, and Freeber reserves the right to refuse use if terms are violated.

User-Supplied Content:

User-provided content includes submissions such as reviews, ratings, or images. Freeber LLC is not responsible for this content and may remove or modify it if it violates Terms or policies. Users are responsible for their content and must respect others’ rights and community standards.

Network Access and Devices:

You are responsible for your internet access and devices. Data traffic fees from your mobile network provider will apply if you use a wireless device. You must ensure you have the necessary hardware to access and use the Services and keep it updated. Freeber LLC does not guarantee compatibility with any specific hardware or device. Network failures and delays may occur due to internet and electronic communication issues.

Payment:

Various payment options are available, and fees may change. Drivers have weekly, biweekly, and monthly payment options, each with specific fees. Fees may increase during peak times or vary by area. Tips are for the driver, but a transfer fee applies. Tipping is voluntary. If a passenger damages or excessively dirties a driver’s vehicle, Freeber may deduct cleaning or repair costs from the passenger’s account based on market rates, which are non-refundable.

Disclaimers; Limited Liability; Indemnification

The Services are provided “as is” and “as available,” with no warranties beyond those expressly stated, including implied warranties of merchantability and fitness for a particular purpose. Freeber makes no guarantees about the quality or performance of the Services. You assume all risk related to the use of the Services.

Limited Liability:

Freeber is not liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits or data. Freeber is not responsible for damages arising from: (i) your use or provision of the Services; or (ii) transactions with third-party service providers, even if Freeber has warned of potential damages. Freeber is not liable for delays or failures beyond its control. Third-party providers may offer services without professional licensing. Freeber’s total liability for damages is capped at 500 EUR. Freeber is not responsible for services provided by third parties beyond what is expressly provided here. This section does not limit liability for consumer rights that cannot be excluded by law.

Indemnification:

You agree to indemnify and hold Freeber and its affiliates harmless from all claims, losses, liabilities, and expenses (including legal fees) related to: (i) the Services or goods obtained through the Services; (ii) violations of these Terms; (iii) Freeber’s use of your content; or (iv) violations of third-party rights.

Governing Law; Mediation

US law governs these Terms. In the event of a dispute, parties must attempt to resolve it amicably. If unresolved, disputes will be submitted to mandatory mediation according to US laws. Mediation will occur at the competent court where the services are provided. US law governs issues not covered by these Terms.

Both parties must keep mediation details confidential. Information from mediation is confidential and accessible only to the involved parties and authorities.

Disputes must be resolved within 30 days; otherwise, they will be subject to mandatory mediation under US law.

Other Provisions

Copyright Requirements:

Freeber retains all copyright and intellectual property rights related to the Services and content. Users may not copy, adapt, distribute, or use Freeber’s content without written permission. Violations may lead to legal consequences, including claims for damages. Users may not use Freeber’s trademarks or intellectual property for personal, advertising, or commercial purposes without prior written consent.
